Webshop sales and warranty terms

Terms and conditions of sale of Metos Webshop

Metos webshop is an online webshop operated by Metos AS (org. 938454213) and sells products to private and public organisations in Norway. Unless otherwise stated in these terms of sale, all agreements are subject to the Sale of goods act. The Metos Webshop is hereinafter referred to as the "Webshop", Metos AS as "Metos", legal entities doing business with Metos AS as "Customer" and the user of the service as "User".

Entry into force of the terms of sale
The Customer accepts these terms and conditions by ordering products from the online store.

Webshop pricing
Prices in the online store are net prices in NOK, VAT will be added. All prices apply to delivery outside the warehouse in Oslo, and include transport packaging. Prices do not include shipping, installation and training at the customer's/user's location. We make reservations about errors that may occur.
We reserve the right to change prices if exchange rates, VAT, production costs, import duties or other fees and charges beyond the supplier's control change before the delivery date.

General
All product shipments are insured for transport damage by Metos. Due to continuous product development, Metos reserves the right to change products, product information and prices. Metos can unilaterally change the terms of sale by announcing them on its website. When an order is placed, the prices and terms of sale valid at that time are applied. Changes resulting from changing regulations enter into force at the time when the regulations enter into force, without separate notification.

In the Outlet store, we make reservations for errors and possibly sold-out products.

Company Account and Customer information
The customer can order in the Webshop without registering a user profile. The payment method for purchases without a user profile will be credit or debit card. By registering with a corporate customer profile, you can choose invoice as a payment method.  Invoice purchases require that the company is creditworthy and that invoices can be sent electronically via EHF or e-mail. When registering a corporate customer profile, Metos reserves the right to carry out a credit check and possibly reject the invoice purchase.

The Company Account may only be used by the Customer whose name is provided during registration. The Customer is responsible for the confidentiality of the user ID and password and the Company Account connected to them, and for limiting access to them. If the Customer has reason to suspect that data security has been compromised, they must immediately inform Metos using the contact form on the website.

Delivery time
The Webshop provides an estimated delivery time for each product. Items that are in stock in Oslo are normally dispatched within 1-2 working days after the order is registered. Items in stock at our head office in Finland are normally dispatched within 7 days after the order is registered. The exact delivery time for ordered goods will be communicated in the order confirmation sent to you.
We do not take responsibility for delayed deliveries.

Delivery
Metos only ships to addresses in Norway. The customer is asked to specify the desired delivery method when placing the order. Otherwise, Metos has the right to ensure that the goods are sent to the place of delivery in the most cost-effective way.

Delivery fee
For orders made via the online store and paid before delivery, the delivery charges are as follows:
If the total value of the order, excluding VAT, is less than NOK 5,000.00, the delivery charge is NOK 400.00 excluding VAT. No delivery charge is required for orders with a value of NOK 5,000.00 or more (excl. VAT).

Payment methods
Customers in the Webshop can choose between the following payment methods:
-Credit card (Visa, Mastercard, Eurocard, American Express)
-Payment by invoice, net per 15 days
This requires an invoice agreement with Metos. If you do not have this, you must register in Metos' online store.

Invoices are delivered as electronic invoices on EHF or e-mail. We charge a processing fee of NOK 300.00 excl. VAT for changes to invoice information requested by the customer after the invoice has been sent.

Unless otherwise agreed, Metos has the right to invoice the agreed purchase price when the goods have been delivered. If the Customer does not pay the invoice by the due date, Metos is entitled to invoice reminder fee and late payment interest of 12.5%. If the invoice amount is not paid after a debt collection notice has been sent, legal debt collection will be initiated and additional debt collection costs will be incurred.

Ownership
Metos AS retains full ownership of all goods sold until the purchase price has been paid in full, including taxes, interest and costs.

Equipment warranty and warranty conditions
The warranty covers repairing raw material or manufacturing defects and resulting damage that has been reported during the warranty period. The mentioned defects are corrected by repairing the product to working condition. Any defective parts replaced with new ones are the property of Metos.

If within 1 year from delivery, or from the time the goods could have been delivered by the seller if this is earlier, material, production or construction defects occur, the goods shall be deemed to have a defect unless the seller can prove that the defect is due to damage or defects that have arisen as a result of:
- the installation not having been carried out by the seller or a person appointed by the seller, and not having been carried out in accordance with user manuals/instructions or applicable public regulations
- inadequate maintenance, treatment/use contrary to instructions for use/instructions or other irresponsible treatment, interventions/repairs carried out by persons who are not authorised repairers of the product or by using non-original parts
- accidents or other circumstances after delivery that are beyond the seller's control, including voltage variations beyond +/- 10% of the labelled voltage, lightning strikes, electrical disturbances or irregularities in the water supply
- corrosion/deposition as a result of placement in abnormally humid rooms or due to water quality
- wear and tear as a result of normal use faults or defects due to material supplied by the buyer, or constructions prescribed or specified by the buyer
- transport or relocation of the product

The warranty also does not apply to the repair of defects that are irrelevant to the functional condition or appearance of the product. Maintenance measures explained in the operating and maintenance instructions, adjustments intended to be carried out by the user and training of the user in the use of the product are not covered by the warranty. Indirect damage is not covered by the warranty.

Requests for warranty repair must be sent to Metos AS without delay and during the warranty period. Equipment that is difficult to move or equipment that is mounted as a fixed part of the kitchen will, if possible, be repaired at the customer's premises. Products that are easy to move can be delivered by the Customer for repair at Meto's workshop at their own expense and responsibility. Repaired equipment can be collected by the Customer or delivered at the Customer's expense using a transport method of the Customer's choice.
Warranty repairs are carried out as soon as possible within normal working hours (Mon-Fri 8:00-16:00). If, at the Customer's request, the work is carried out outside normal working hours, the cost of this work, including overtime payment, will be incurred.

Complaints/responsibility for non-conformity
The Customer undertakes immediately, and no later than 7 days after receipt of the item(s), to inform the seller in writing of any faults/defects in the delivered product so that we can verify and rectify the problem.
Depending on the situation, the product may be replaced or repaired, or the matter may be resolved with a reduction in price. Metos' liability will in all cases be limited to the purchase price paid by the Customer. Metos is not liable for any direct or indirect costs or lost revenue resulting from defective products and services, or the use thereof.

Returns
Returns of the item(s) are accepted if the delivery does not correspond to the order or if the goods are defective, and if the seller has been informed within 7 days after the Customer has received the item(s). Returns must always be agreed in advance with our Customer Centre. A maximum of 80% will be refunded for returns of standard products if the return is not due to the seller's fault. The customer has no right to return customised products and special products.

The return of an ordered product must be agreed with Metos' customer centre, which can be contacted on tel. +47 924 28 860. Opening hours are Mon.- Fri. 08:00-16:00. When a return is agreed, a return document will be sent to the Customer. This document must be attached to the product being returned. The Customer must return the product at their own expense to Metos at the following address:
Metos AS, Rosenholmveien 4A, 1252 Oslo. When Metos receives the product, it will be checked.
When the return is approved, a credit note will be issued for the agreed amount, which will be paid to the Customer to the same account that was used to make the payment.
